Terms of Use

The rules for using Traveley, what the plans include, and how subscriptions are billed.

These Terms of Use (“Terms”) govern your use of Traveley (“the App”), published by Avakiam (“we”, “us”, “our”), based in Girona, Spain. By downloading, opening or using the App you agree to them. If you do not agree, please do not use the App.

What Traveley is

Traveley builds day-by-day travel itineraries from a destination and a set of dates or a trip length, using an artificial intelligence model. It also writes a short practical briefing for a destination, an estimate of what the planned days cost, and a packing list.

Everything the App produces is a suggestion generated by software, not professional travel advice. We are not a travel agency, a tour operator, an insurer or a financial adviser, and nothing in the App is any of those things.

AI-generated content, and what it means for you

Itineraries, briefings, cost estimates and packing lists are written by an AI model. They can be wrong. A model can name a place that has closed, misstate an opening time, quote a price that has changed, or describe an entry requirement inaccurately.

You are responsible for checking anything you are going to act on — above all opening hours, prices, availability, and visa and entry rules — with the venue, the operator or an official source, before you book, pay or travel. Cost figures in the App are estimates of some of the planned activities only; they are not quotes, they do not include everything, and they are not a budget you should rely on.

Every itinerary has a report button. If the App produces something offensive, unsafe or plainly wrong, please use it — it is how we find and fix what the model gets wrong.

Accounts

You can plan itineraries without an account. Signing in, through Google, is needed to save itineraries and to buy anything, so that what you save and what you pay for follows you to another device.

You are responsible for the Google account you sign in with and for what happens under your Traveley account. Tell us if you believe someone else is using it. You may delete your account at any time from the menu in the App; see how to delete your account.

The App is not intended for children under 13, and you must be old enough to consent to a contract where you live in order to buy anything.

Free plan, credit packs and Traveley Pro

Traveley is offered on three footings, and the differences are deliberate:

  • Free. A limited number of itineraries for the lifetime of the device — not per month, and they do not reset. Signing in does not increase them. You may be offered an extra itinerary in exchange for watching a video advertisement; watching is always optional.
  • Credit packs. A one-off purchase of additional itineraries. They do not expire, and they are attached to your account rather than to your handset.
  • Traveley Pro. A monthly subscription. It includes a set number of itineraries each month, which do reset at the start of each month and do not carry over; it removes advertisements while it is active; and it adds weather information to the packing list.

Refinements — asking the AI to change an itinerary it has already produced — are limited per itinerary, and that limit is the same on every plan. A pack or a subscription buys more itineraries, never more edits of one itinerary.

Credits you have bought are not consumed while a Pro subscription is covering the month; they remain in your account and are available if the subscription ends.

The exact allowances are shown in the App and may change. If we reduce what a plan includes, the change will not apply to a subscription period you have already paid for.

Payment, renewal and cancellation

All purchases are made through the app store you installed the App from — today, Google Play. The store takes the payment; we never receive or see your card details. The price shown to you is the store's, in your own currency and inclusive of any tax the store collects.

A subscription renews automatically at the end of each period, and is charged to your store account, until you cancel it. To cancel, use the subscription settings in Google Play — not the App, which cannot cancel it for you. Cancelling stops the next renewal; it does not end the period you have already paid for, and you keep Pro until that period runs out.

If we change the price of a subscription, the store will notify you and ask for your agreement before the new price is charged, in accordance with its own rules.

Refunds and your right to withdraw

Refunds are handled by the store that took the payment, under that store's policy. Requests should go to Google Play in the first instance. We can help you find a purchase, but we cannot refund a payment we never received.

If you are a consumer in the European Union, you normally have 14 days to withdraw from a distance contract for digital services. Where you ask us to begin providing the service immediately — which is what happens the moment a subscription is activated and used — you may be asked to acknowledge that you lose that right once the service has been fully performed, or that you will owe an amount proportionate to what has been supplied. Nothing in these Terms removes any mandatory consumer right you have under the law of the country you live in.

Bookings and partner links

Traveley does not sell tickets, tours or accommodation, and takes no bookings. Where an itinerary stop is something that can be booked, the App may offer a link to a booking partner. Those are affiliate links: if you book after following one, we may be paid a commission by the partner. You pay the same price as you would going to the partner directly, and this is disclosed in the App where the links appear.

What you then do on a partner's site is a contract between you and that partner, governed by their terms and their privacy policy. We are not a party to it, and we are not responsible for their prices, availability, cancellations or service. Your plan is built first; booking links are attached to it afterwards, and nothing is suggested because a partner happens to sell it.

Acceptable use

Please do not:

  • Use the App for anything unlawful, or to plan anything unlawful.
  • Try to bypass the limits on free itineraries, including by resetting device identifiers, automating requests, or creating accounts in bulk.
  • Attempt to gain access to accounts, data or systems that are not yours, or to interfere with the service.
  • Enter other people's personal data, or anything sensitive, into the free-text fields.
  • Deliberately prompt the model to produce illegal, hateful or harmful output.
  • Scrape, resell or redistribute content generated by the App at scale, or present it as your own product.

We may suspend or close an account that breaks these rules, and we may limit or refuse service where we reasonably believe it is being abused.

Content and intellectual property

The App itself — its software, design, name and branding — belongs to us, and nothing in these Terms transfers that to you. You are given a personal, non-transferable licence to use the App.

The itineraries generated for you are yours to use for your own travel, including sharing them with the people you are travelling with. Text you write yourself — notes, packing items — remains yours; you give us only the permission needed to store it, show it back to you and operate the service.

Place names, photographs and other third-party material shown in the App remain the property of their owners and are used under their own terms. Photographs come from Wikipedia and Wikimedia Commons under the licences stated there, and weather data is provided by Open-Meteo under a Creative Commons licence; both are credited in the App.

Availability and changes

We aim to keep the App working, but it is offered as is and we do not promise it will be uninterrupted or error-free. It depends on services we do not control, including app stores, an AI model provider and our hosting provider, and any of them can fail or change.

We may add, change or remove features, and we may stop offering the App. If we discontinue a paid feature you have an active subscription to, we will not charge you again for it and will let the current period run out or refund the unused part.

Liability

To the extent the law allows, we are not liable for indirect or consequential loss, or for loss arising from your reliance on AI-generated content — a missed opening time, an inaccurate price, a place that has closed, or a journey planned around any of those. We are not liable for the acts or omissions of booking partners, transport operators or venues.

Where we are liable, our total liability is limited to the amount you have paid us for the App in the twelve months before the claim.

None of this limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud. If you are a consumer, your statutory rights are unaffected.

Ending these Terms

You may stop using the App at any time, and delete your account from within it. We may suspend or end your access if you break these Terms, or if we stop offering the service. Ending your access does not entitle us to keep money for a subscription period you have paid for but cannot use because we ended it.

Governing law

These Terms are governed by Spanish law. If you are a consumer resident in the European Union, you keep the protection of the mandatory rules of the country you live in, and you may bring proceedings there. The European Commission also provides an online dispute resolution platform for consumers.

Changes to these Terms

We may update these Terms, for example when the App gains or loses a feature. Material changes will be reflected by updating the “Last updated” date at the top of this page, and continuing to use the App after that means you accept the updated Terms. A change affecting a subscription will not be applied to a period already paid for.
